Jury Hung In Aggravated Vehicular Homicide Trial

A new trial will be set for a Scioto County man charged with two counts of aggravated vehicular homicide.

Jurors found David Harshberger Jr.,42, guilty on one count of weapon under disability and one count of possession of crack cocaine.

But jurors were hung on the other two charges.

The Ohio State Highway patrol says Harshberger was driving when he lost control of his car and went off an embankment.

The crash resulted in the deaths of his girlfriend and two-year-old daughter.

Harshberger testified that he was not even in the car when the accident occurred.

He was sentenced to 18 months in jail for the two guilty verdicts, but will serve no jail time since he has already served 20 months since the initial arrest.

New trial dates will be set.
