Judge To Mull Chemical Disposal Ban At West Virginia Fill

A judge is due to decide whether to make permanent an order barring wastewater from a Charleston chemical spill from being taken to a Putnam County landfill.

Kanawha County Circuit Judge Paul Zakaib is scheduled to hear a request Friday from the city of Hurricane and the Putnam County Commission.

He issued a temporarily ban Monday against the state Department of Environmental Protection from allowing wastewater to be dumped at the Disposal Services landfill in Hurricane.

The material contains traces of the crude MCHM that spilled Jan. 9 at Charleston's Freedom Industries, contaminating 300,000 people's drinking water for days.

Putnam County officials have said they weren't told about Waste Management's plan to dump the material at Disposal Services.
