COLUMBUS, Ohio (AP) – The Ohio Supreme Court has dismissed a lawsuit filed against the state’s elections chief by backers of an effort aimed at controlling prescription drug prices.

The dismissal comes after Republican Secretary of State Jon Husted sent the so-called Drug Price Relief Act to state lawmakers last week for consideration.

Supporters of the proposal had sued Husted last month after he asked local elections boards to further review petition signatures. The lawsuit had sought to advance the initiative to lawmakers.

The proposed law is aimed at keeping state entities from buying drugs at prices higher than the U.S. Department of Veterans Affairs pays. A similar plan qualified for California’s 2016 ballot.

Ohio lawmakers have four months to consider the proposal. Backers could then try to put the initiative before voters.
