CHARLESTON, W.Va. (AP) – A U.S. congressman’s seat will remain vacant until January once he resigns to serve on the West Virginia Supreme Court.

News outlets report Republican Rep. Evan Jenkins of West Virginia was appointed Saturday by Gov. Jim Justice to replace Robin Davis. She retired from the Supreme Court hours after the state House of Delegates impeached her and three other justices this month.

The impeachment probe was prompted by questions involving more than $3 million in renovations to the justices’ offices and expanded to accusations including corruption.

Jenkins will serve as justice until voters in November elect him or another candidate to finish Davis’ term.

Donald Kersey oversees elections and is deputy legal counsel for West Virginia’s secretary of state. He says Jenkins’ seat will stay open because the election is forthcoming.
