Attorney General Asks For Overturning of Abortion Decision

COLUMBUS, Ohio (AP) – Ohio’s attorney general has asked the state Supreme Court to overturn a July decision that allowed a Cleveland abortion clinic to proceed with legal action challenging several abortion restrictions placed into a 2013 state budget bill.

Attorney General Mike DeWine said in the filing Monday that Preterm-Cleveland has no standing to speak in court for doctors and hospitals regulated by the provisions.

The amendments included prohibiting public hospitals from providing emergency backup under required transfer agreements and requiring clinics to check for a fetal heartbeat before conducting an abortion.

A three-judge panel of the 8th District Ohio Court of Appeals in Cuyahoga (ky-uh-HOH’-guh) County found Preterm had standing to sue last month, saying the provisions clearly caused Preterm injury. That reversed a trial court decision which found Preterm lacked standing.
