ODOT Liable For Death Of New Concord Woman
< < Back to odot-liable-death-new-concord-womanA court has ordered Ohio's transportation department to pay $4 million to the family of a woman killed the day after Christmas in 2008 when a tree fell on her car while she was driving with her 5-year-old son
The Ohio Court of Claims previously found that the Department of Transportation was negligent and liable for the death of 40-year-old Traci Reed of New Concord in eastern Ohio.
The court on Tuesday ordered that the department pay $4 million to Reed's husband of 14 years and her two children for her loss and their mental anguish.
The court found that the department knew about the hazardous tree and could have prevented Reed's death by removing it.
The department had argued that Reed was killed by an "act of God."
