ACLU Seeking Ruling Over Ohio Budget Abortion Rules

The American Civil Liberties Union of Ohio is pushing for a hearing and summary ruling in a lawsuit over abortion-related provisions contained in Ohio's two-year budget.

The court filing on Monday comes as abortion clinics have been grappling with one provision added to the budget that bans publicly funded hospitals from having patient transfer agreements with facilities that provide abortions.

Ohio law simultaneously requires such transfer agreements to be in place, in what abortion rights groups have dubbed a de facto restriction on abortion.

The case was filed on behalf of a Cleveland women's health clinic in October 2013 in Cuyahoga County Common Pleas Court.

The suit says three abortion-related parts of the budget, including the transfer agreement, violate a constitutional rule holding bills to a single subject.
