Judge: Clumm Can’t Seek New Trial on 1977 Murder Conviction

William Clumm, 72, filed a motion last week in Athens County Common Pleas Court asking for permission to file a motion for a new trial in the murder of Francine Spain Clumm. Clumm asserted that there is a newly discovered witness. Normally, a motion for a new trial based on newly discovered evidence must be filed within 120 days of the guilty verdict, unless the court grants permission for it to be filed late.
