PRINCETON, W.Va. (AP) – A family is accusing West Virginia State Police troopers and a Division of Natural Resources officer of excessive force and violating their civil rights after police were called on a neighbor in 2016.

A lawsuit filed last month in the Southern District of West Virginia says Trooper Lamont F. Lee placed Russell Lilly in a police cruiser after Ronnie Hurt spotted him firing a gun. The Charleston Gazette-Mail reports Lilly placed a call claiming to be a kidnapped officer.

The lawsuit says Trooper John R. Tupper and DNR Officer Marshall Richards yanked Hurt and his daughter to the ground. The newspaper says both were hurt.

Tupper, Marshall and Trooper Benjamin Wood have said Hurt was resistant to officer’s orders.
