The Libertarian Party of Ohio is appealing a federal judge's order in an effort to get its gubernatorial candidate on the May primary ballot.

The party had asked a federal judge to order that Charlie Earl be included on the ballot, but the request was denied Wednesday.

Ohio's elections chief had disqualified Earl along with a candidate for attorney general after their nominating petitions were challenged.

The party appealed the denial Thursday to the 6th U.S. Circuit Court of Appeals in Cincinnati. Attorneys also asked the court to compel Secretary of State Jon Husted to ask for an exemption to avoid printing the primary ballots Saturday.

Earl's candidacy would have the potential to draw votes from Republican Gov. John Kasich as he faces likely Democratic challenger Ed FitzGerald.
