Abortion Clinic To Close Unless It Appeals Judge’s Ruling
< < Back to abortion-clinic-close-unless-it-appeals-judges-rulingA suburban Cincinnati abortion clinic that had remained open while fighting the state's closure order will have to close unless it files an appeal or other legal action.
A Hamilton County judge ruled Friday that he doesn't have jurisdiction to change the Ohio Department of Health order closing the Lebanon Road Surgery Center in Sharonville.
A center attorney says the clinic is considering options including appealing the ruling by Judge Jerome Metz Jr.
The health department ordered the facility closed in January after questioning whether it followed rules to provide backup care for patients.
The clinic argued that proper backup care always has been in place and the closure stemmed from political and arbitrary reasons.
Metz had allowed the clinic to remain open pending his ruling.
