W.Va. Supreme Court Extends Delay in Union Case Enforcement

CHARLESTON, W.Va. (AP) — The West Virginia Supreme Court has extended a delay in enforcing a lower court ruling that struck down part of a state law allowing workers to stop paying union dues.
The Kanawha County ruling came last month in a lawsuit by the state AFL-CIO and other unions. The court said the ruling wouldn’t take effect for 30 days to give time for an appeal, but that expired Friday.
Attorney General Patrick Morrisey is appealing and asked that the lower court ruling not be allowed to take effect pending appeal, citing possible confusion for employers and employees and irreparable harm to the state. The Supreme Court granted the request Friday.
State AFL-CIO President Josh Sword said the ruling wasn’t unexpected, and one of the attorneys for the unions, Robert M. Bastress Jr., also said such a stay wasn’t unusual.
