Roberts' credit card after Roberts died, was found in violation of his community control and sent to prison Tuesday, according to a release from Athens County Prosecutor Keller Blackburn.
Degarmore, 52, had his community control revoked and was sentenced to 18 months in prison, but will receive jail credit in excess of a year for time he has already served.
“Degarmore was found to have violated the terms of his Community Control for violations including being complicit to being in possession of a credit card that did not belong to him and that he did not have permission to possess; receiving gas using Paul E. Roberts’s credit card without permission; associating with Paul J. Roberts, who was under indictment and awaiting sentence; helping scrap Paul E. Roberts’s hot water heater; transporting a stolen pool table; and admitting to using heroin on two different occasions,” Blackburn said in the release.
Degarmore was originally indicted for aggravated trafficking in drugs, which is a fourth-degree felony.
Paul J. Roberts, the son of Paul E. Roberts, is still awaiting trial on murder charges. He was sentenced to a year in jail in December on theft charges.
